Privacy Laws and Applicable Regulations: The Inventory<\/h1>\n

Privacy<\/strong> Laws and Applicable Regulations: this is a big deal.<\/p>\n

Earlier, we talked about the importance of setting down a solid Privacy Governance<\/strong> program. If you missed the post, you can have a look at it clicking here<\/strong><\/a>.<\/p>\n

Now it is time to focus our attention to inventory all the privacy laws and regulations<\/strong> applicable to your company. Applicable Privacy Laws<\/h2>\n

Primarily, I have to say that simplifying the explanation for the concept of the privacy laws applicability<\/strong> is never<\/strong> a good idea.<\/p>\n

In fact, the task of the privacy laws inventory<\/strong> is one of the most delicate (and technical<\/strong>) step of the whole privacy program<\/strong>.<\/p>\n

Consequently, we suggest you to call a privacy expert <\/strong>and if you don’t know anyone, you can always call this guy<\/strong><\/a>…<\/p>\n

At length, I will summarize the applicable rules of thumb<\/strong>.<\/p>\n

Where are you based? It affects the applicable privacy laws
\n<\/strong><\/h3>\n

The location of your establishment<\/strong> is crucial to determine the applicable privacy legislation<\/strong>.<\/p>\n

For example: you’re based in Portugal and all of your customers (and their personal data<\/strong>) are in Brasil<\/strong><\/a>. For that reason, the\u00a0GDPR<\/strong> will be applicable to your company and, of course, the Portuguese\u00a0privacy law<\/strong> as well.<\/p>\n

So far, so good but… What if you have establishments in Portugal and<\/strong> in Brasil? Well, in this case both privacy laws<\/strong> are applicable.<\/p>\n

Where are your customers based?<\/strong><\/h3>\n

In addition to the right answer to the first question about the location of your establishment<\/strong>, you should focus your attention to the location of your customers<\/strong> (again, and their personal data<\/strong>).<\/p>\n

Are they based all over the world? Congratulations! Your marketing and customer service teams have done a great job.<\/p>\n

But now the compliance team<\/strong> will take the lead, in order to ensure that your expansion will not lead you to a catastrophic point-of-no-return.<\/p>\n

In which sector are you working in?<\/strong><\/h3>\n

Financial Services<\/strong>? Then, among others, you better be prepared for the GLBA<\/strong><\/a>.<\/p>\n

Did you say Health Sector<\/strong>? Really? Are you sure that the HIPAA<\/strong><\/a> is not applicable to your company?<\/p>\n

Privacy Laws Inventory: too tough?<\/h2>\n

We mentioned only the very basic questions<\/strong> you should answer, in order to have a general idea of your privacy laws inventory<\/strong>.<\/p>\n
